Article 1 – DEFINITIONS
The following terms have the following meaning in these terms and conditions:
Entrepreneur – the natural or legal person acting in the context of his trade, business, craft or profession, with the following identity:

Consumer – the buyer who is acting for purposes outside his trade or profession
Parties – the entrepreneur and the consumer
Offering – the products, services, or the digital content or service that the
entrepreneur offers for sale to the consumer
Purchase – the product, service, or digital content or digital service that is purchased by the entrepreneur’s consumer through the purchase agreement
Reflection period – the period within which the consumer has the right of withdrawal Day – calendar day
Right of withdrawal – the right for the consumer to cancel the purchase within the cooling-off period
Purchase agreement – the conclusion of an agreement in which the entrepreneur undertakes to give a good and the consumer undertakes to pay a purchase price for this good
Distance selling – a purchase agreement concluded between the entrepreneur and the consumer in the context of an organized system for distance selling or services without the simultaneous personal presence of the entrepreneur and the consumer and where only one or more means are used for remote communication
Article 2 – APPLICABILITY
1. These general terms and conditions apply to all distance purchase agreements concluded between the entrepreneur and the consumer.
2. Before concluding the purchase agreement, the general terms and conditions are made available to the consumer in such a way that they can be stored by the consumer.
3. If additional or deviating terms and conditions apply to the purchase agreement, these will be provided to the consumer in the same way.
4. In the event of conflicting additional or deviating terms and conditions, the terms and conditions most favorable to the consumer will apply.
Article 3 – PURCHASE AGREEMENT
1. The distance purchase contract is concluded through an offer from the entrepreneur and acceptance of this offer by the consumer.
2. The offer is fully and truthfully described by the entrepreneur, including the associated conditions.
3. The entrepreneur informs the consumer of his rights and obligations associated with acceptance of the offer.
4. The entrepreneur states clearly and legibly with the offer, and at the latest at the beginning of the ordering process, whether there are any restrictions on delivery and which payment methods are accepted.
5. When concluding the agreement, the entrepreneur provides the consumer with the following information in a clear and comprehensible manner:
a) the identity, postal and visiting address, telephone number and e-mail address of the entrepreneur;
b) the main features of the purchase;
c) the price of the purchase including all taxes and any delivery charges;
d) the method of payment, delivery and execution, and the associated terms and any costs;
e) the entrepreneur’s complaint-handling policy;
f) if the consumer has a right of withdrawal, the conditions, term and modalities for exercising that right, where applicable the method of return of the purchase, and where applicable the reimbursement of costs, as well as the model form for dissolution;
g) if the consumer does not have a right of withdrawal, the information that the consumer does not have a right of withdrawal or, where applicable, the circumstances in which the consumer waives his right of withdrawal;
h) a reminder of the existence of the legal guarantee that the purchase must comply with the contract, and any assistance to the consumer after purchase;
i) where applicable, the duration and termination conditions of the agreement;
j) where applicable, the existence and conditions of financial guarantees to be provided by the consumer at the request of the trader.
6. If the agreement was created at a public auction, the provision of the information of the information referred to in paragraph 5 under a is met by providing the corresponding information from the auctioneer.
Article 4 – RIGHT OF WITHDRAWAL
1. The consumer has 14 days from the conclusion of the agreement to withdraw from the agreement without stating reasons.
2. The reflection period starts on the day after the consumer has received the product.
3. If the purchase consists of several products, the reflection period starts on the day after the consumer has received the last product.
4. If the product is delivered in multiple shipments, the reflection period starts on the day after the consumer has received the last shipment.
5. The above remains unaffected if the product is received by a third party designated by the consumer.
6. If there is an agreement for the supply of water, gas or electricity that has not been made ready for sale in a limited volume or in a specific quantity, or for district heating, the reflection period starts on the day after the agreement is concluded. .
7. For withdrawal, the consumer can use the withdrawal form provided by the entrepreneur, or another unambiguous statement to that effect to the entrepreneur.
8. If the requirements set out in Article 3, paragraph 5, under f are not met, the cooling-off period referred to in paragraph 1 of this article will be extended by the time that has elapsed from the time when the cooling-off period commenced until all missing data has been provided to the consumer in the prescribed manner, with a maximum extension of 12 months.
9. The right of withdrawal does not apply in the following cases, provided that the entrepreneur has clearly stated to the consumer prior to concluding the agreement that the right of withdrawal is excluded:
a) agreements whose purchase price is subject to fluctuations in the financial market over which the entrepreneur has no influence and which may occur within the termination period;
b) contracts concluded at a public auction;
c) agreements in which the consumer has specifically requested the entrepreneur to visit him to carry out urgent repairs or maintenance, unless:
– it concerns additional services that the consumer has not expressly requested;
– it concerns the delivery of goods other than those necessary to carry out the maintenance or repair;
(d) contracts for the supply of products manufactured on the basis of consumer choice, or clearly intended for the specific consumer;
e) contracts for the supply of products that spoil quickly or have a limited shelf life;
f) contracts for the supply of products which cannot be returned for reasons of health or hygiene protection and of which the seal has been broken after delivery;
g) agreements for the delivery of products that are irrevocably mixed with other items after delivery by their nature;
h) contracts for the supply of alcoholic beverages, the price of which was agreed upon at the time of the conclusion of the contract, but of which:
– delivery can only take place after 30 days, and;
– the actual value depends on fluctuations in the market over which the entrepreneur has no influence;
i) agreements for the delivery of audio recordings, video recordings and computer software, the seal of which has been broken after delivery;
j) contracts for the supply of newspapers, periodicals or magazines, with the exception of a contract for regular delivery of such publications.
Article 5 – DISSOLUTION
1. If the consumer has the right of withdrawal, makes use of this right within the reflection period, and has informed the entrepreneur about this by means of the model form for dissolution provided by the entrepreneur, or another unambiguous statement to that effect, the agreement between the parties dissolved.
2. By dissolution of the purchase agreement, all additional agreements are also dissolved by operation of law.
3. After dissolution, the entrepreneur shall immediately, but within 14 days after receipt of the provisions referred to in paragraph 1 of this article, reimburse all payments received from the consumer, including the delivery costs, in proportion to the part of the agreement that is dissolved, on the same payment method used by the consumer to pay for the purchase, unless the consumer has expressly agreed to another free payment method.
4. If the consumer has opted for a different delivery than the cheapest delivery chosen by the entrepreneur when concluding the agreement, the entrepreneur is not obliged to refund the additional costs for this method of delivery.
5. If the purchase has already been delivered or has been sent for delivery, the consumer shall immediately return the purchase in good condition after dissolution, but within 14 days after the notification referred to in paragraph 1 of this article was issued or hand it over to the entrepreneur or a person designated by the entrepreneur, unless due to the nature of the purchase it must be picked up by the entrepreneur.
6. Unless it has been agreed that the entrepreneur will collect the purchase, the consumer can only claim compliance with the refund referred to in the previous paragraph when the entrepreneur has received the purchase or provides the consumer with proof of return of the purchase to the entrepreneur.
7. The costs for returning the purchase are for the account of the consumer, unless the entrepreneur has failed to inform the consumer that these costs are for his account.
8. The consumer is only liable for depreciation of the purchase if he has used the purchase more or differently than necessary to determine the nature, characteristics and functioning of the purchase. The consumer is not liable for depreciation if the entrepreneur has not provided the information in accordance with Article 3, paragraph 5 under f.
9. If the consumer withdraws from the agreement after he has expressly requested the execution of the agreement for the supply of water, gas or electricity, which have not been prepared for sale in a limited volume or in a specific quantity, or for district heating, the consumer owes the entrepreneur an amount that is proportional to that part of the contract that has been fulfilled by the entrepreneur at the time of exercising the right of withdrawal. The proportional amount that the consumer must pay to the entrepreneur is calculated on the basis of the total price as laid down in the agreement, insofar as the total price is not excessive. If the total price is excessive, the prorated amount will be calculated based on the market value of the part of the contract that has been executed.
10. The consumer bears no costs for the supply of water, gas or electricity, which have not been prepared for sale in a limited volume or in a certain quantity, or for district heating, which have been provided in whole or in part during the withdrawal period, if:
– the entrepreneur has failed to provide the information in accordance with Article 3, paragraph 5, under f or g, or;
– the consumer has not expressly requested the aforementioned delivery during the cancellation period.
11. The consumer is not liable and does not owe any costs by exercising his right of withdrawal, without prejudice to the provisions of paragraph 8, as well as Article 5, paragraph 4.
Article 6 – PRICE
1. The prices stated in the offer are in euros and include VAT.
2. The entrepreneur is not authorized to increase the stipulated price after the agreement has been concluded, unless the consumer is authorized to dissolve the agreement in the event of a price change.
3. The prohibition referred to in the previous paragraph does not apply if the price increase is the result of a statutory price increase.
4. In the event of a price increase, the consumer will be informed in good time, and at the latest one month before the price change, of the effective date of the change and the changed price.
Article 7 – PAYMENT
1. When entering into the agreement, the entrepreneur is authorized to require a down payment from the consumer of a maximum of 50% of the purchase price.
2. Until the deposit has been paid by the consumer, the consumer cannot assert any rights with regard to the execution of the agreement.
3. The part of the payment that takes place afterwards must be paid by the consumer within ________ days after the start of the reflection period, or if no reflection period applies, after the conclusion of the agreement.
4. If the consumer does not comply with his payment obligation or does not comply in time, whereby the payment terms apply as strict deadlines, the consumer is in default by operation of law. In the event that the consumer still does not pay after another 14 days to complete the payment, the consumer owes statutory interest on the outstanding amount and the entrepreneur can charge the extrajudicial collection costs incurred by him. bring.
5. The entrepreneur can only deviate from the legally determined amount of the statutory interest and collection costs on the outstanding payment in favor of the consumer.
Article 8 – DELIVERY
1. The entrepreneur ensures that the purchase is delivered in a careful manner, at the location that the consumer has indicated as the delivery address.
2. The risk associated with delivery rests with the entrepreneur until the moment of delivery to the consumer or a third party designated by the consumer, unless expressly agreed otherwise.
3. The consumer must ensure that the delivery can take place on time.
4. Delivery takes place without delay, but within 30 days after the conclusion of the agreement, unless a different delivery time has been agreed and/or stated in the offer.
5. If the agreed delivery time is exceeded, the consumer is authorized to dissolve the agreement without costs.
6. In the event that there is dissolution in accordance with the previous paragraph, and the purchase price has already been paid in full or in part by the consumer, the entrepreneur will immediately refund the amount paid.
Article 9 – WARRANTY
1. The entrepreneur ensures that every purchase meets the specifications of the offer and the reasonable requirements for normal use.
2. Any seller’s or manufacturer’s warranty provided by the entrepreneur to the consumer does not affect the scope of the legal warranty.
3. The above guarantees do not apply in the event of normal wear and tear or damage caused by culpable incompetent use, or negligence in the maintenance of the purchase by the consumer.
Article 10 – COMPLAINTS AND DISPUTES
1. Dutch law applies to every agreement between the parties.
2. The entrepreneur has a complaint handling procedure that is accessible to the consumer.
3. If the consumer has a complaint, this complaint must be immediately and clearly described to the entrepreneur.
4. The entrepreneur responds to complaints within 14 days.
5. In the event of an irresolvable complaint, it can also be submitted to the competent court.

De volgende termen hebben in deze algemene voorwaarden de volgende betekenis:

Consument – de koper die handelt voor doeleinden buiten zijn bedrijfs- of beroepsactiviteit
Partijen – de ondernemer en de consument
Aanbod – de producten, diensten, of de digitale inhoud of dienst die de
ondernemer aanbiedt ter verkoop aan de consument
Aankoop – het product, de dienst, of de digitale inhoud of digitale dienst dat door middel van de koopovereenkomst wordt gekocht door de consument van de ondernemer
Bedenktijd – de termijn waarbinnen de consument herroepingsrecht heeft Dag – kalenderdag

Koop op afstand – een koopovereenkomst die tussen de ondernemer en de consument wordt gesloten in het kader van een georganiseerd systeem voor verkoop of dienstverlening op afstand zonder gelijktijdige persoonlijke aanwezigheid van de ondernemer en de consument en waarbij enkel gebruik wordt gemaakt van één of meer middelen voor communicatie op afstand
Artikel 2 – TOEPASSELIJKHEID
1. Deze algemene voorwaarden zijn van toepassing op alle tot stand gekomen koopovereenkomsten op afstand tussen de ondernemer en de consument.
2. Voor het sluiten van de koopovereenkomst worden de algemene voorwaarden beschikbaar gesteld aan de consument op dusdanige wijze dat deze opgeslagen kunnen worden door de consument.
3. Indien voorts aanvullende of afwijkende voorwaarden van toepassing zijn op de koopovereenkomst, worden deze op dezelfde wijze verschaft aan de consument.
4. In het geval van tegenstrijdige aanvullende of afwijkende voorwaarden zijn de voor de consument meest gunstige voorwaarden van toepassing.
Artikel 3 – KOOPOVEREENKOMST
1. De koopovereenkomst op afstand komt tot stand door aanbod van de ondernemer en aanvaarding van dit aanbod door de consument.
2. Het aanbod wordt door de ondernemer volledig en waarheidsgetrouw omschreven, inclusief de bijbehorende voorwaarden.
3. De ondernemer brengt de consument op de hoogte van zijn aan aanvaarding van het aanbod toebehorende rechten en plichten.
4. De ondernemer vermeldt bij het aanbod, en uiterlijk aan het begin van het bestelproces, duidelijk en leesbaar of er beperkingen gelden voor de levering en welke betaalmiddelen worden aanvaard.
5. Bij het sluiten van de overeenkomst verstrekt de ondernemer de consument op duidelijke en begrijpelijke wijze de volgende informatie:
a) de identiteit, het postadres en het bezoekadres, het telefoonnummer, en het e- mailadres van de ondernemer;
b) de voornaamste kenmerken van de aankoop;
c) de prijs van de aankoop met inbegrip van alle belastingen en eventuele leveringskosten;
d) de wijze van betaling, levering en uitvoering, en de bijbehorende termijnen en eventuele kosten;
e) het klachtafhandelingsbeleid van de ondernemer;
f) indien de consument herroepingsrecht heeft, de voorwaarden, termijn, en modaliteiten voor de uitoefening van dat recht, voor zover van toepassing de wijze van retournering van de aankoop, en voor zover van toepassing de kostenvergoeding, alsmede het modelformulier voor ontbinding;
g) indien de consument geen herroepingsrecht heeft, de informatie dat de consument geen herroepingsrecht heeft of, voor zover van toepassing, de omstandigheden waarin de consument afstand doet van zijn recht op herroeping;
h) een herinnering aan het bestaan van de wettelijke garantie dat de aankoop aan de overeenkomst moet voldoen, en de eventuele bijstand aan de consument na aankoop;
i) voor zover van toepassing de duur en de opzegvoorwaarden van de overeenkomst;
j) voor zover van toepassing, het bestaan van en de voorwaarden voor financiële garanties die de consument op verzoek van de ondernemer moet verschaffen.
6. Indien de overeenkomst is ontstaan op een openbare veiling wordt aan het verstrekken van de informatie van het in lid 5 onder a genoemde voldaan door de overeenkomstige gegevens van de veilingmeester te verstrekken.
Artikel 4 – HERROEPINGSRECHT
1. De consument heeft vanaf het sluiten van de overeenkomst 14 dagen bedenktijd om de overeenkomst te herroepen zonder opgave van redenen.
2. De bedenktijd gaat in op de dag nadat de consument het product heeft ontvangen.
3. Indien de aankoop uit meerdere producten bestaat, gaat de bedenktijd in op de dag nadat de consument het laatste product heeft ontvangen.
4. Indien het product middels meerdere zendingen wordt geleverd, gaat de bedenktijd in op de dag nadat de consument de laatste zending heeft ontvangen.
5. Het bovenstaande blijft onverlet van toepassing indien het product door een door de consument aangewezen derde wordt ontvangen.
6. Indien sprake is van een overeenkomst tot levering van water, gas of elektriciteit, die niet gereed voor verkoop zijn gemaakt in een beperkt volume of in een bepaalde hoeveelheid, of tot stadsverwarming, gaat de bedenktijd in op de dag nadat de overeenkomst wordt gesloten.
7. Voor herroeping kan de consument het door de ondernemer verschafte herroepingsformulier gebruiken, dan wel een andere daartoe strekkende ondubbelzinnige verklaring aan de ondernemer.
8. Indien niet aan de in artikel 3, lid 5 onder f gestelde eisen is voldaan, wordt de in lid 1 van dit artikel genoemde bedenktijd verlengd met de tijd die is verstreken vanaf het tijdstip waarop de bedenktijd is ingegaan, tot het moment waarop alle ontbrekende gegevens alsnog op de voorgeschreven wijze aan de consument zijn verstrekt, met een maximale verlenging van 12 maanden.
9. Het recht op herroeping is niet van toepassing in de volgende gevallen, mits de ondernemer voorafgaand aan het sluiten van de overeenkomst duidelijk heeft vermeld aan de consument dat het recht op herroeping is uitgesloten:
a) overeenkomsten waarvan de prijs van de aankoop gebonden is aan schommelingen op de financiële markt waarop de ondernemer geen invloed heeft en die zich binnen de ontbindingstermijn kunnen voordoen;
b) overeenkomsten die zijn gesloten op een openbare veiling;
c) overeenkomsten waarbij de consument de ondernemer specifiek verzocht heeft hem te bezoeken om dringende herstellingen of onderhoud te verrichten, tenzij:
– het aanvullende dienstverlening waar de consument niet uitdrukkelijk om heeft verzocht, betreft;
– het de levering van andere zaken dan die noodzakelijk zijn om het onderhoud of herstel uit te voeren, betreft;
d) overeenkomsten tot de levering van producten die zijn vervaardigd op basis van de keuze van de consument, of duidelijk voor de specifieke consument bestemd zijn;
e) overeenkomsten tot de levering van producten die snel bederven, of een beperkte houdbaarheid hebben;
f) overeenkomsten tot de levering van producten die ter bescherming van de gezondheid of hygiëne niet teruggezonden kunnen worden en waarvan de verzegeling na de levering is verbroken;
g) overeenkomsten tot de levering van producten die na levering door hun aard onherroepelijk vermengd zijn met andere zaken;
h) overeenkomsten tot de levering van alcoholische dranken waarvan de prijs overeen is gekomen bij het sluiten van de overeenkomst, maar waarvan:
– de levering slechts na 30 dagen kan plaatsvinden, en;
– de werkelijke waarde afhankelijk is van schommelingen van de markt waarop de ondernemer geen invloed heeft;
i) overeenkomsten tot de levering van audio-opnamen, video-opnamen en computerprogrammatuur waarvan de verzegeling na de levering is verbroken;
j) overeenkomsten tot de levering van kranten, tijdschriften of magazines, met uitzondering van een overeenkomst voor geregelde levering van dergelijke publicaties.
Artikel 5 – ONTBINDING
1. Indien de consument herroepingsrecht heeft, binnen de bedenktijd gebruik maakt van dit recht, en de ondernemer hierover op de hoogte heeft gebracht middels het door de ondernemer verschafte modelformulier voor ontbinding, of een andere daartoe strekkende ondubbelzinnige verklaring, wordt de overeenkomst tussen de partijen ontbonden.
2. Door ontbinding van de koopovereenkomst worden van rechtswege alle aanvullende overeenkomsten alsmede ontbonden.
3. Na ontbinding vergoedt de ondernemer onverwijld, doch binnen 14 dagen na ontvangst van het in lid 1 van dit artikel genoemde, alle van de consument ontvangen betalingen met inbegrip van de leveringskosten naar verhouding van het deel van de overeenkomst dat wordt ontbonden, op dezelfde betaalwijze als door de consument gebruikt is ter betaling van de aankoop, tenzij de consument uitdrukkelijk met een andere kosteloze betaalwijze heeft ingestemd.
4. Indien de consument bij het sluiten van de overeenkomst heeft gekozen voor een andere levering dan de door de ondernemer gekozen goedkoopste levering, is de ondernemer niet verplicht de bijkomende kosten voor deze leveringswijze terug te betalen.
5. Indien de aankoop reeds is geleverd of ter levering is verstuurd, zendt de consument na ontbinding onverwijld, doch binnen 14 dagen na het uitbrengen van de in lid 1 van dit artikel genoemde mededeling, de aankoop in goede staat terug of overhandigt deze aan de ondernemer of een door de ondernemer aangewezen persoon, tenzij op grond van de aard van de aankoop deze door de ondernemer opgehaald dient te worden.
6. Tenzij overeen is gekomen dat de ondernemer de aankoop komt ophalen, kan de consument eerst nakoming vorderen van de in het voorgaande lid genoemde terugbetaling wanneer de ondernemer de aankoop heeft ontvangen of de consument een bewijs verschaft van terugzending van de aankoop aan de ondernemer.
7. De kosten voor het terugzenden van de aankoop komen voor rekening van de consument, tenzij de ondernemer heeft nagelaten de consument mede te delen dat deze kosten voor zijn rekening komen.
8. De consument is slechts aansprakelijk voor waardevermindering van de aankoop als hij de aankoop meer of anders dan noodzakelijk heeft gebruikt dan ter vaststelling van de aard, kenmerken en werking van de aankoop. De consument is niet aansprakelijk voor waardevermindering indien de ondernemer de informatie overeenkomstig artikel 3, lid 5 onder f niet heeft verstrekt.
9. Indien de consument de overeenkomst herroept nadat hij uitdrukkelijk heeft verzocht tot uitvoering van de overeenkomst tot het leveren van water, gas, of elektriciteit, die niet gereed zijn gemaakt voor verkoop in beperkt volume of in een bepaalde hoeveelheid, of tot stadsverwarming, is de consument de ondernemer een bedrag verschuldigd dat evenredig is aan dat gedeelte van de verbintenis dat door de ondernemer is nagekomen op het moment van uitoefening van het herroepingsrecht. Het evenredige bedrag dat de consument aan de ondernemer moet betalen, wordt berekend op grond van de totale prijs zoals vastgelegd in de overeenkomst, voor zover de totale prijs niet excessief is. Indien de totale prijs excessief is, wordt het evenredige bedrag berekend op basis van de marktwaarde van het gedeelte van de overeenkomst dat is uitgevoerd.
10. De consument draagt geen kosten voor de levering van water, gas of elektriciteit, die niet gereed zijn gemaakt voor verkoop in beperkt volume of in een bepaalde hoeveelheid, of tot stadsverwarming, die geheel of gedeeltelijk tijdens de herroepingstermijn zijn verleend, indien:
– de ondernemer heeft nagelaten de informatie overeenkomstig artikel 3, lid 5 onder f of g te verstrekken, of;
– de consument niet uitdrukkelijk heeft verzocht tot bovengenoemde levering tijdens de ontbindingstermijn.
11. De consument is niet aansprakelijk en is geen kosten verschuldigd door de uitoefening van zijn herroepingsrecht, onverminderd het genoemde in lid 8, alsmede artikel 5, lid 4.
Artikel 6 – PRIJS
1. De in het aanbod genoemde prijzen zijn in euro en inclusief btw.
2. De ondernemer is niet bevoegd de bedongen prijs na het sluiten van de overeenkomst te verhogen, tenzij de consument bevoegd is in geval van prijswijziging de overeenkomst te ontbinden.
3. Het in het voorgaande lid genoemde verbod geldt niet indien de prijsverhoging het gevolg is van een wettelijke prijsverhoging.
4. In het geval van een prijsverhoging wordt de consument tijdig, en uiterlijk een maand voor de prijswijziging, van de ingangsdatum van de wijziging en de gewijzigde prijs op de hoogte gebracht.
Artikel 7 – BETALING
1. Bij het aangaan van de overeenkomst is de ondernemer bevoegd een aanbetaling te verlangen van de consument van ten hoogste 50% van de aankoopprijs.
2. Tot het moment dat de aanbetaling door de consument is voldaan, kan de consument geen enkel recht doen gelden met betrekking tot de uitvoering van de overeenkomst.
3. Het deel van de betaling dat achteraf plaatsvindt, dient door de consument te worden voldaan binnen ________ dagen na het ingaan van de bedenktijd, of ingeval er geen bedenktijd van toepassing is, na het sluiten van de overeenkomst.
4. Indien de consument zich niet of niet tijdig aan zijn betalingsverplichting houdt, waarbij de betalingstermijnen als fatale termijnen gelden, is de consument van rechtswege in verzuim. In het geval dat de consument na nogmaals 14 dagen de tijd te hebben gekregen om de betaling alsnog te voltooien de betaling nog steeds niet voldoet, is de consument over het uitstaande bedrag wettelijke rente verschuldigd en kan de ondernemer de door hem gemaakte buitengerechtelijke incassokosten in rekening brengen.
5. De ondernemer kan enkel in het voordeel van de consument afwijken van de wettelijk bepaalde hoogte van de wettelijke rente en incassokosten over de uitstaande betaling.
Artikel 8 – LEVERING
1. De ondernemer draagt zorg voor het leveren van de aankoop op een zorgvuldige wijze, op de locatie die de consument heeft aangegeven als afleveradres.
2. Het aan levering toebehorende risico berust bij de ondernemer tot het moment van aflevering bij de consument of een door de consument aangewezen derde, tenzij uitdrukkelijk anders overeen is gekomen.
3. De consument dient zorg te dragen dat de levering tijdig kan plaatsvinden.
4. Levering vindt onverwijld, doch binnen 30 dagen na het sluiten van de overeenkomst, plaats, tenzij een andere levertijd is overeengekomen en/of bij het aanbod is vermeld.
5. Indien de overeengekomen levertijd wordt overschreden, is de consument bevoegd de overeenkomst zonder kosten te ontbinden.
6. In het geval dat er sprake is van ontbinding overeenkomstig het voorgaande lid, en de aankoopprijs reeds geheel of gedeeltelijk is betaald door de consument, betaalt de ondernemer het betaalde bedrag onverwijld terug.
Artikel 9 – GARANTIE
1. De ondernemer draagt er zorg voor dat iedere aankoop voldoet aan de specificaties van het aanbod, en aan de redelijke eisen voor normaal gebruik.
2. Iedere verkopers- of fabrieksgarantie die wordt verstrekt door de ondernemer aan de consument, laat de strekking van de wettelijke garantie onverlet.
3. Bovengenoemde garanties gelden niet in het geval van normale slijtage of schade veroorzaakt door verwijtbaar ondeskundig gebruik, dan wel nalatigheid in het onderhoud van de aankoop door de consument.
Artikel 10 – KLACHTEN EN GESCHILLEN
1. Op iedere overeenkomst tussen de partijen is het Nederlands recht van toepassing.
2. De ondernemer beschikt over een voor de consument toegankelijke klachtafhandelingsprocedure.
3. Indien de consument een klacht heeft, dient deze klacht onverwijld en duidelijk omschreven aan de ondernemer kenbaar gemaakt te worden.
4. De ondernemer geeft reactie op klachten binnen 14 dagen.
5. In het geval van een onoplosbare klacht kan deze tevens worden voorgelegd aan de bevoegde rechtbank.
